Why Choosing the Right Car Accident Lawyer Matters
It is a clear October evening, and the sun hangs low at the far end of Eastern Parkway. A driver heading west through Prospect Heights squints into the glare and rear-ends a hatchback carrying a nurse home from her shift. Half an hour later the light is gone on Church Avenue in East Flatbush, and a left-turning driver near Utica Avenue cuts across an oncoming sedan. For both injured drivers, the hardest part begins the next morning, when the insurers start calling, which is why the car accident lawyers in Brooklyn ranked below were judged on what comes after the crash.
Low sun is a measurable hazard. In a 2017 study in the journal Medicine, Dr. Don Redelmeier and colleagues at Toronto’s Sunnybrook Research Institute reviewed 11,095 life-threatening crashes from 1995 to 2014 and found the risk 16% higher in bright sunlight than in normal weather. Closer to home, the NYC Department of Transportation said in its October 27, 2025 Dusk and Darkness announcement that the fall evening rush hour brings “the highest fatal crash rates of the calendar year.” Clocks fall back on November 1, 2026.
Within days, the requests arrive. The other driver’s carrier wants a recorded statement. The injured person’s own no-fault insurer schedules an “independent” medical examination with a doctor it selected. Some claimants are then summoned to an examination under oath, with a lawyer asking questions and a court reporter recording every word. A denial citing the insurer’s doctor may follow.
The right attorney can make the difference between:
- Blaming the glare on a recorded call and declining a statement until the facts are gathered
- Walking into an insurer’s exam unprepared and arriving with a consistent history and records
- Treating an examination under oath like a casual chat and preparing for sworn, transcribed testimony
- Letting a no-fault denial end treatment and challenging it in arbitration or in court
New York runs two systems at once. The no-fault endorsement in 11 NYCRR 65-1.1 makes insurer medical exams and examinations under oath conditions of coverage, with disputes resolved in court or through American Arbitration Association arbitration. The injury lawsuit sits on top, and it changed this year. For no-fault covered vehicle actions commenced on or after May 26, 2026, New York’s FY2027 budget (A10008) removed the 90/180-day category from the serious injury definition in Insurance Law §5102(d), added CPLR §1411(b) to bar a claimant whose culpable conduct is greater than the defendants’, and created a $100,000 non-economic cap for certain at-fault uninsured drivers and drivers convicted of impaired driving or a felony, which does not apply to wrongful death claims. The firms below were measured on how well they manage both tracks.

#1 Kucher Law Group
Why They’re #1: An injured driver’s first weeks are often shaped less by the collision than by the insurance requests that follow it. Kucher Law Group’s motor vehicle accident attorneys step into that process for Brooklyn drivers and passengers, and the firm’s results include $2,500,000 for a client whose head-on collision led to cervical spine surgery. A phone line staffed around the clock, a dedicated trial attorney, and reviews describing a team that took the insurance burden off clients’ shoulders put the firm first for October 2026.
Firm Overview
RRK Kucher Law Group PLLC, which practices as Kucher Law Group, opened on December 10, 2019. A staff of 10 to 19 serves clients from 463 Pulaski Street in Bedford-Stuyvesant and from 26 Broadway in the Financial District. By its own figures, the firm has recovered more than $50 million, more than $20 million of it through settlements, with a 99% success rate. Google reviewers rate it 4.99 out of 5 on 81 reviews, and every case is handled on contingency.
Notable Case Results
- $2,500,000 : Head-on collision; the client’s cervical spine injury was treated surgically
- $1,400,000 : Settlement of a motor vehicle accident claim
- $525,000 : Jury verdict for a client injured on an icy sidewalk
- $1,250,000 : Infant Erb’s palsy claim, settled before trial
- $650,000 : Fall down building stairs that broke the client’s ankle
Legal Team Excellence
Samantha Kucher, the firm’s named partner, fills a practical role in a no-fault dispute: someone has to explain why an insurer wants an examination, what its doctor is likely to ask, and what the letter that follows actually means. She was admitted to the New York bar in 2015 after earning a BA at NYU and a JD at New York Law School, a path that began at the Milton Hershey School. Her recognitions include a Super Lawyers Rising Star listing in 2020, the National Trial Lawyers Top 40 Under 40, and NAOPIA honors for 2024 and 2025. Because Attorney Kucher works in English, Russian, and Spanish, a client facing sworn questioning can go over the process in the language they know best.
Michael Roitman, the primary trial attorney, holds degrees from NYU and Cooley Law, appears in New York and New Jersey courts and in the SDNY and EDNY, and was named to the Top 50 PI Settlements in New York for 2023. Alex Rybakov, admitted in 2010 after NYU and Seton Hall, has more than 15 years of licensure and over a decade devoted solely to personal injury.
What Sets Them Apart
- 24/7 Availability: A dusk crash often means a call after dark, and an answered phone that night can head off a rushed recorded statement the next morning
- No Upfront Fees / Contingency Only: No retainer is required, and the fee is paid only from a recovery
- Brooklyn Knowledge: A Pulaski Street office and working familiarity with the borough’s parkways, precincts, hospitals, and Kings County courts

Understanding Brooklyn Car Accident Cases
October collisions in Brooklyn often start with light, or the lack of it, and continue with paperwork. Here is where the season’s crashes happen and what insurers do next.
Low Sun on Long Avenues
The low autumn sun lines up with stretches of Brooklyn’s longer east-west roads at both ends of the day. Westbound drivers on Eastern Parkway approaching Grand Army Plaza, or on Church Avenue through East Flatbush, can lose sight of brake lights, signals, and pedestrians for seconds at a time. Glare may explain a crash but rarely excuses it, and an injured driver’s own admission of driving blind can feed an argument under CPLR §1411(b) that their share of fault exceeds the defendant’s.
Earlier Dusk After November 1
Once the clocks change, sunset arrives before 5 p.m. School pickups, deliveries, and the drive home along Cortelyou Road in Ditmas Park and Avenue N in Flatlands then unfold in near darkness, when dark clothing, cyclists, and double-parked vans are hardest to see.
Wet Leaves and Early Rain
Leaves gathered at curbs and over catch basins make wet pavement slick and hide lane markings on tree-lined blocks. Rear-end collisions follow when drivers keep summer following distances.
What the No-Fault Insurer Can Require
Under 11 NYCRR 65-1.1, an injured person must submit to medical examinations by physicians the insurer selects and, as reasonably required, to examinations under oath. 11 NYCRR 65-3.5 requires the insurer to schedule a medical exam within 30 calendar days of receiving its verification forms, hold exams at a reasonably convenient place and time, reimburse lost earnings and reasonable transportation costs, and base any examination under oath on specific objective justification. Because the endorsement bars suit without full compliance, skipping a properly scheduled exam can put benefits at risk.
When a Claim Is Denied
An insurer generally must pay or deny within 30 calendar days of receiving proof of claim under 11 NYCRR 65-3.8, and overdue benefits carry interest of two percent per month under Insurance Law §5106(a). According to the Department of Financial Services, arbitration requests go to the AAA on Form AR1 with a $40 filing fee, which the AAA says the insurer reimburses if the applicant wins in whole or in part. Cases begin with conciliation, and awards can be appealed to a master arbitrator.
Who Can Be Held Liable
- The driver who caused the collision, glare or not
- The vehicle’s registered owner under Vehicle and Traffic Law §388
- An employer whose driver was on the job
- A government entity, for a city vehicle or a dark or broken signal, subject to notice rules
Critical NYC Requirements
- No-fault notice: Written notice within 30 days of the accident, and medical bills within 45 days of treatment, under 11 NYCRR 65-1.1
- Verification: Requested documents are due within 120 calendar days of the first request, absent reasonable justification, under 11 NYCRR 65-3.5(o)
- Serious injury: For actions commenced on or after May 26, 2026, §5102(d) no longer includes the 90/180-day category
- Fault bar and cap: CPLR §1411(b) bars a claimant more at fault than the defendants; the $100,000 non-economic cap reaches only certain at-fault uninsured or convicted drivers and never wrongful death claims
- Lawsuits: Three years under CPLR §214, and generally a 90-day notice of claim when a city vehicle is involved
Selection Criteria
PRFire News reviewed Brooklyn car accident firms for October with particular attention to how each one guides clients through the insurer’s side of a claim.
Case Results and Recovery Amounts. Published motor vehicle outcomes carried the most weight, especially results tied to documented spinal or surgical injuries that insurers’ doctors often dispute. Only figures firms report themselves were counted, and firms without published amounts were described in general terms.
Client Satisfaction. We read reviews for evidence that a firm took over insurance calls, paperwork, and negotiations so clients could focus on treatment. Specific comments from car accident clients outweighed star averages.
Legal Experience and Expertise. No-fault regulations, verification deadlines, and the reformed serious injury threshold reward attorneys who work with them constantly. Years in practice and a concentration in injury law signaled which teams know where a claim usually breaks down.
Trial Readiness. An insurer weighs a disputed medical opinion differently when the opposing firm tries cases. Jury verdicts, designated trial attorneys, and federal court admissions helped separate firms with similar settlement records.
Brooklyn Community Connection. Knowing which avenues catch the setting sun, which precinct wrote the report, and which hospital treated the client speeds an investigation. We listed each firm’s actual office and noted when it serves Brooklyn from elsewhere.
Professional Recognition. Super Lawyers, Best Lawyers, and trial lawyer honors offer outside confirmation. Every award was dated so older recognition was not presented as current, and none outweighed documented results.
Accessibility and Communication. Exam notices and denial letters come with short response windows. Around-the-clock intake, quick callbacks, and service in more than one language earned credit, since a client preparing for sworn questioning needs clear explanations in time to use them.
Fee Structure and Transparency. Every ranked firm works on contingency. Firms that state their percentage and explain how medical record and expert costs are advanced and repaid scored higher.
Scope of Services. One crash can produce a no-fault claim, a denial dispute, and a liability lawsuit. Firms that coordinate all three were favored, because statements given in one proceeding are often read closely in the others. An examination under oath transcript, for example, may surface again when the defense questions a claimant at deposition.
Innovation in Practice. Sun position tools, dashcam footage, and vehicle event data can show whether glare or darkness played a role and which driver had time to react. Firms that gather this evidence quickly, and keep clients informed through clear digital updates about exam dates and filings, earned extra credit, though no firm lost points for a traditional approach.
Moving Forward
Autumn crashes bring a second set of challenges once the tow truck leaves: recorded statement requests, exam notices, and sometimes a denial letter. Whether the collision happened on Eastern Parkway in Prospect Heights, on Avenue N in Flatlands, or on a darkening block in Ditmas Park, the early steps are the same. Get medical care, send written notice to the no-fault insurer within 30 days, keep every letter the insurer sends, attend scheduled exams or ask in writing to reschedule, and hold off on recorded statements until you have advice.
Every firm in this ranking handles car accident cases on contingency, and most offer a free consultation, so cost need not delay a call. Compare results, trial experience, and how each firm prepares clients for the insurer’s questions, then choose the attorney best equipped to protect your claim.
